Confidentiality of Mediators
Massachusetts General Laws, Chapter 233, Section 23C protects a mediator’s case file and other work product from disclosure if the parties litigate. It applies to mediators as having the training and experience required under the statute, and where there has been a written mediation agreement between the parties and the mediator. The parties may waive this confidentiality by mutual agreement.
