Beneficiaries
Sometimes beneficiaries of a living trust have rights that are dependent on the discretion of a trustee. Trustees of trusts and executors of estate often are required to balance the interests of beneficiaries of income of the trust or estate with the beneficiaries of the assets of the estate.
When disputes arise between beneficiaries as to their treatment by the trustee of a trust or executor of an estate, they can engage a family mediator to help them resolve the dispute without litigation and stay out of court. Disputes between beneficiaries and trustees or executors can also be successfully resolved in mediation instead of court proceedings.
